Christmas: how to make the warranty work for your defective gifts?

You were about to launch a family game of your brand new board game, but finally had to give up because some parts were missing from the box? The sound of your brand new headphones only comes out of one side? Rest assured, your gifts are not lost. In the event of a defect, it can be returned to the sender thanks to the legal guarantee of conformity.

This legal guarantee of conformity, for a period of two years, is even enshrined in law, the product received having to be "in conformity with the expected use and the description of the seller". “This guarantee is insufficiently known by consumers and is not put forward correctly by professionals”, explains Olivier Gayraud, lawyer at the association Consumption housing and living environments, to our colleagues from FranceTVinfo. Be careful not to confuse it with the consumption guarantee, which is offered directly by retailers.

Currently applicable to household appliances, custom-made furniture or even vehicles, the warranty will be extended to online video games, subscriptions to software, a television channel or streaming music from January 1, 2022.

Noël : comment faire fonctionner la garantie de vos cadeaux défectueux ?

If you are in possession of equipment that is actually defective, the seller must offer you either the repair or the replacement of the item. To obtain a full refund, it will be necessary in this case to determine that the repair and the replacement are not possible, or that they cannot be carried out within one month. Be careful, however, you risk losing this guarantee by trying to repair the object in question yourself.

Another detail to know: the legal guarantee of conformity does not apply during a purchase between individuals. It can however be applied to a reconditioned product.
