I do not want my ex-wife to receive my survivor's pension, do I have the right to give it to my sister or my concubine?
Your ex-spouse is, for the general scheme, a beneficiary of your survivor's pension. It is impossible to "give" it to your sister or your concubine.
There are, however, two exceptions that can eliminate the right to a survivor's pension:
– Conviction for the homicide of the spouse or ex-spouse.
– Certain crimes and misdemeanors against the deceased insured, as provided for in article 103 of law n°2020-1576 of 14/12/2020.
Marriage being the first condition giving right to the survivor's pension, your concubine will only be able to claim it in the event of marriage. In this case, the survivor's pension from the general scheme would be divided between the wives in proportion to the duration of the marriage.
Note that your ex-spouse will receive your survivor's pension from the general scheme subject to meeting certain conditions:
– Be at least 55 years old
– Have resources not exceeding 21,320 euros annually (ie 1,776 euros monthly) for a single person and 34,112 euros for the household if you are a couple.
If you are a civil servant, your ex-spouse will also have to meet certain conditions to receive your survivor's pension:
– Have one or more children from this marriage
– The marriage must have lasted at least four years
– The marriage must have been celebrated at least two years before your retirement
Good to know: If your ex-wife is remarried, she will no longer be entitled to the survivorship of certain schemes for which you could have contributed, as is the case for civil servants or for the Agirc supplementary pension. Arrco.
