Right of withdrawal for iTunes: Apple refunds within 14 days | iGeneration
Apple has posted a new document regarding the right of withdrawal for iTunes content. In Europe, it is possible to exercise your right of withdrawal “within 14 days of receipt of your receipt without giving any reason”. To exercise your right, you can go to the dedicated site used to Report a problem; after identification, we will choose the content in question then we will select the problem, and it will be possible to further describe the problem encountered. The consumer can also write to the headquarters of iTunes, in Luxembourg (everything is described in the PDF document).
Notice of cancellation must be sent within 14 days of receipt of receipt. Apple will refund within a maximum of 14 days from the date of receipt of the cancellation notification. No additional fees will be charged for reimbursement.
This process applies to all content offered on Apple's online stores, with the exception of iTunes Match, Season Pass, Multi-Pack, iTunes Bundle, and iTunes Gifts and Provisions which cannot be refunded once their code has been used - for these last two services, the refund can however be obtained through iTunes Support.
This is the first time that Apple has explicitly defined its support for the right of withdrawal in Europe, as the EU decided in 2011 for online purchases (in fact, the legislation came into force in June of this year).
Update — Apple specifies in the conditions of exception to this right of withdrawal that the cancellation will not be possible if the download has started "following [the] request", which would mean that one could not request the refund after the start of the content download. This will relieve many developers because very often, the downloading of the content in question begins automatically after payment.
We tried the refund process via the problem report page. With an album, the refund was automatic, although the content had been downloaded beforehand, and was still playable in our library.Despite the precautions taken by Apple to prevent abuse, our test with an application proved successful: we were able to get a refund for the djay 2 app purchased and duly downloaded, without any other form of trial.
